
James Klatsky has broad multi-disciplinary experience in commercial litigation and in corporate and real estate transactional law. His litigation experience includes major litigation in state and federal courts, including commercial, international, debtor-creditor, foreclosure, securities, fraud, arbitration, bankruptcy, employment, civil rights and matrimonial litigation. Mr. Klatsky has an active practice in state and federal appellate courts and has argued in excess of thirty appeals. His reported decisions include: Omni Quartz, Ltd. v. CVS Corp., 287 F.3d 61 (2d Cir. 2001)(breach of contract), Belle Harbor Washington Hotel, Inc. v. Jefferson Omega Corp., 17 A.D.3d 612, 795 N.Y.S.2d 597 (2d. Dept. 2005)(successful defense of specific performance), Tobias v. First City National Bank, 709 F. Supp. 1266 (S.D.N.Y. 1988) (successful defense of claim for securities fraud); 1414 Realty Corp. v. G & G Realty Co., 707 N.Y.S.2d. 319 (2nd Dept. 2001) (reversal of the dismissal of a complaint for failure to deliver a lease); Hartman v. R.P. McCoy Apparel, Ltd., 535 N.Y.S.2d 423 (1st Dept. 1988) (successful defense of an employee wrongful termination action) and numerous others. Mr. Klatsky’s transactional experience includes corporate organization and dissolution, licensing of trademarks and other intellectual property, commercial real estate transactions, including purchases and sales, commercial leasing, and commercial mortgage loan transactions. Fluent in Italian and French, he has extensive experience in international litigation representing clients from Italy, France, Japan, Britain, Switzerland, Venezuela and Israel. He received a B.A. degree in 1981 from Columbia University and a J.D. degree in 1984 from Columbia Law School. James is admitted in all state and federal courts in New York, and is admitted to practice before the United States Supreme Court and the United States Supreme Court of Appeals for the Third Circuit. James previously resided in Rome, Italy, and has traveled extensively in Europe and Asia.
